Watchful eyes are trained on the Federal Trade Commission and Department of Justice amid reports they have divvied up jurisdiction over Google, Facebook, Amazon and Apple, but perhaps the states are deserving of more attention. With major lawsuits challenging the generic pharmaceutical industry and the T-Mobile/Sprint merger, states have demonstrated they are willing to take on challenging antitrust litigation without federal enforcers. In a public comment filed to the FTC earlier this week, 43 state attorneys general called for a subtle “recalibration” of antitrust enforcement to take a more aggressive approach toward technology platforms.
