Gleiss Lutz

Professional notice

Germany

Partner and Who’s Who Legal nominee Ingo Brinker leads the competition team at Gleiss Lutz. Most of the firm’s 42 competition lawyers – one of the largest antitrust teams in Germany – are located in Berlin, Düsseldorf, Frankfurt, Hamburg, Munich and Stuttgart, while some work in the Brussels’ office. The team includes 10 partners, nine of whom are Who’s Who Legal nominees.

The team worked on most major cartel proceedings by the Federal Cartel Office and very often represents clients in European Commission cartel cases. State aid is another key area for the firm, alongside complex merger control work. Among a number of Phase II merger reviews, Gleiss Lutz worked on sugar company Südzucker’s takeover of rival ED&F Man, cleared with remedies. Bosch also relied on the firm for merger control advice, and partner Ulrich Dentzel lodged an appeal for ProSiebenSat.1 Media and RTL against the prohibition of their internet TV catch-up service joint venture.

On the behavioural side, Gleiss Lutz worked on a number of cartel investigations conducted by the Federal Cartel Office and the European Commission, including probes in the automotive parts sector. The firm’s lawyers also advised companies in international antitrust proceedings worldwide. Partner Christian Steinle, for example, worked on the first leniency application ever submitted to Pakistan’s antitrust agency on behalf of Siemens.

The group advised clients before the European Courts, the Düsseldorf Higher Regional Court and the Federal Court of Justice. “Settlement proceedings will play an increasingly important role for clients in future at both national and European levels,” says the firm. In the past year, the practice worked on the carbonless paper appeal before the Federal Court of Justice – the first cartel damages case heard by Germany’s highest court.

Gleiss Lutz has been involved in shaping antitrust law since day one, having played an active role in all major international developments and cases for more than 60 years. The combination of experience, top quality advice and a practice-oriented approach makes Gleiss Lutz one of the leading competition practices in Europe.

  • Cartel investigations: With experience gained from participating in more or less all cartel investigations before the European Commission and many cartel investigations all over the globe over the last years, Gleiss Lutz is the law firm of choice for high-profile cases. Especially in the area of the Commission’s settlement proceedings the firm is a pioneer, having participated in all settlement proceedings of the European Commission to date.
  • Actions for damages: Gleiss Lutz has been involved in the development of “private enforcement” from the outset. Its leading position is illustrated by the representation of a client in the first follow-on case at the German Supreme Court. In actions covering various jurisdictions Gleiss Lutz plays a coordinating role, working together with law firms across the globe.
  • Merger control: Gleiss Lutz is regularly involved in complex cases, such as advising Syngenta on the acquisition of Monsanto’s seeds business and Südzucker on the acquisition of ED&F. In cross-border proceedings Gleiss Lutz provides strategic advice in the run-up to the acquisition, and coordinates the filing of the required notifications worldwide.
  • Gleiss Lutz’ antitrust practice also has highly regarded experts for state aid, in particular in the finance sector, and for compliance matters. Because of the significant experience and partner-driven approach to matters, clients regularly retain the services of Gleiss Lutz for international internal investigations, most recently in Brazil, in Pakistan, in Korea, in Turkey and in China.
