Sidley Austin LLP

Professional notice

Brussels

Sidley Austin has a team of five partners and four associates working in the Brussels competition practice. Partner and Who’s Who Legal nominee Stephen Kinsella OBE leads the team, together with managing partner Stephen O Spinks. The firm’s EU competition group also includes two partners and three associates in London, all of whom work extensively on matters generated in Brussels.

This year, the EU competition group worked on Alberto-Culver’s US$3.7 billion acquisition by Unilever. It advised ECT, a subsidiary of Hutchison Port Holdings, on the antitrust, state aid and public procurement aspects of its container terminal operations in ports across Europe. And the team is representing the European Commission before the General Court in relation to four appeals filed against commission decisions in the copper fittings cartel case.

The competition group is of counsel to LG Electronics in the commission’s investigation of an alleged LCD panels cartel. The team succeeded in convincing DG Comp that the company should not be held jointly and severally liable for the conduct of a former joint venture.

Other clients include Microsoft and Talecris Biotherapeutics.

Elsewhere, Who’s Who Legal nominee John W Treece leads the way for Sidley Austin, a Chicago mainstay and one of the top firms in the region for both litigation and merger work. Treece says litigation has focused on the firm’s impressive portfolio of pharmaceutical clients over the past year or so and that mergers have picked up considerably since dipping in 2009.

On the pharmaceutical front, the firm has been prominent on high-stakes patent tying cases and other patent lawsuits that straddle antitrust and intellectual property issues. Clients there include AstraZeneca and others. Outside of the pharma industry, the firm has acted for AT&T, a main defendant in Chicago’s text-messaging class action, as well as SSAB in the ongoing steel antitrust case.

On the merger front, the team helped racetrack Churchill Downs clear a second request, guided the sale of most of the Kerasotes Theatres cinema chain to rival AMC, and led Corn Products International through its takeover of National Starch from AkzoNobel.

Combining experience and innovation to deliver cutting-edge competition services around the globe.
