Eisenberger & Herzog has three partners, each with their own areas of specialisation within the competition field: Dieter Thalhammer, Andreas Zellhofer and Ulrike Sehrschön. All three are Freshfields alumni. They work alongside four associates.

In the last year, the firm has been advising three national and multinational companies on whether to file for leniency at the Austriawn Federal Competition Authority.

The team is representing Primagaz – the Austrian subsidiary of the world’s largest liquefied petroleum gas (LPG) supplier – in cartel proceedings before the Austrian Cartel Court alleging illegal information exchange within the Austrian LPG association. It is also acting for Rail Cargo Austria in the largest ever cartel case in terms of market size and level of potential fines. The company is accused of involvement in a cartel in the Austrian freight forwarding business alongside more than 40 alleged co-conspirators. Eisenberger & Herzog is also defending a consortium of plumbing companies facing accusations of bid rigging.

On the transactional side, the firm advises clients including EQT, Rail Cargo Austria, österreichische Post and Wiener Stadtwerke Holding as lead counsel for multijurisdictional merger filings. The firm also represented Austrian Airlines when it intervened in the merger of AirBerlin and FlyNiki.

Nikon, Honda, Nissan and Volvo Truck all rely on the firm for advice on distribution issues.
