Advocacia José Del Chiaro is the home of one of the country’s best-known antitrust specialists. José Del Chiaro Ferreira da Rosa is a former head of the SDE, and a founder member of Ibrac, Brazil’s largest competition-focused group to which most of Brazil’s competition lawyers belong. Del Chiaro is also a nominee in The International Who’s Who of Competition Lawyers and Economists.
The competition team has six partners and three associates. The team is representing mobile phone company TIM in an investigation of a price-squeeze complaint from rival Global Village Telecom; Kaiser in an abuse of dominance case against Ambev; and Alcoa in an investigation of an alleged cartel in the flexible packaging sector.
On the mergers side the firm is advising Volkswagen and Hypermarcas on the notifications of several transactions in Brazil.
Other clients include ArcelorMittal Brasil, Bayer, Femsa, CNH Latin America, Embratel, Ericsson, Itaú, Holcim Brasil, Kraft Foods, Metalnave, Merck, Medial Saúde, Phillip Morris, Renault, Santos Brasil and Volkswagen.
Advocacia José Del Chiaro
Advocacia José Del Chiaro was founded by Mr. José Del Chiaro in 1991, shortly after he stepped down as Secretary of Economic Law at the Ministry of Justice.
It is not a large, multi-service law firm. Mr. Del Chiaro’s goal was always to build a world-class boutique focusing on antitrust, concentration and associated areas, offering clients results-driven excellence within the chosen field of specialization.
The nine-strong legal team offers unparalleled experience in Brazilian antitrust and associated areas, including litigation. They combine solid legal training with a rich background that includes spells with the Brazilian government and associated institutions, and work closely with a small group of economists who specialize in antitrust. All the senior team is fluent in English; most speak Spanish.
The head office is in São Paulo, Brazil’s business center, but the company also has its own fully-integrated office and partners in the federal capital of Brasília to ensure close contact with relevant authorities and courts.
Advocacia José Del Chiaro handles virtually all antitrust work for Hypermarcas, a leading Brazilian consumer goods group with more than 100 brands, and is currently representing a major food multinational with respect to a potential acquisition. It has considerable experience in other sectors through its work for clients such as Air Liquide, Alcoa, Bayer, Ericsson, Kraft, Renault, Vale, and Volkswagen.
Among the landmarks was representing Philip Morris against Souza Cruz (the Brazilian subsidiary of British American Tobacco) in an unfair trading practices action that is still studied as a leading case.
