Huy Do and Antonio Di Domenico head the competition group at FASKEN MARTINEAU DUMOULIN, which includes three other partners, four counsel and one associate. Fasken advised paper manufacturer Intertape Polymer Group on its €2.3 billion sale to an affiliate of US-based private equity firm Clearlake Capital and also counselled aftermarket auto parts distributor Uni-Select on its €2 billion purchase by rival LKQ. The bureau cleared both deals unconditionally. Away from merger control, the firm continues to represent BASF Canada in an abuse of dominance investigation stemming from complaints by multiple seed and crop protection product manufacturers and wholesalers that allege the company refused to supply the Farmers Business Network Canada. Sandoz also tapped the team to defend it against a generic pharmaceutical price-fixing class action seeking nearly €2 billion in damages.

FASKEN’s antitrust team is led by Lesley Morphet and Neil MacKenzie. The firm bolstered its practice with the hire of Veronica Cadman from Thomson Wilks in April 2023. The firm is helping the South African Petroleum Industry Association obtain several competition law exemptions for activities it claims are required to ensure the continuity and stability of the country’s liquid fuels supply chain. It also represents Nomura International before the Competition Tribunal in challenging allegations levied as part of the SACC’s forex cartel investigation. Elsewhere, the team advised Nomad Royalty Company on its sale to Sandstorm Gold and counselled Amcor on the 90 million rand (€5.2 million) divestiture of its South African businesses to CTP Publishers and Printers.
