Subrata Bhattacharjee heads the competition practice at BORDEN LADNER GERVAIS, working alongside four other partners, two counsel and three associates. The team advised Parrish & Heimbecker when the bureau sought a court order forcing the company to divest one of 10 grain elevators acquired from Louis Dreyfus in December 2019. Canada’s Competition Tribunal rejected the bureau’s challenge in October 2022, ruling it had wrongly defined the relevant product market and failed to prove the deal would substantially lessen competition in the supply of wheat and canola. BLG is also advising Netflix on its purchase of Australian animation studio Animal Logic. Elsewhere, the team is defending Amazon against multiple class action lawsuits filed to the Federal Court of Canada and other courts in Ontario and Quebec, which claim its policies deterring third-party sellers from charging higher prices on its platform constitutes price fixing under the Competition Act. The Federal Court in August 2023 denied certification in one of those claims after ruling that the pleadings failed to disclose a reasonable cause of action against Amazon.
