Areas of Expertise

The Team works in all areas of competition law. It has a strong presence in restrictive agreements (including cartels and leniency), abuse of dominance, damages actions, merger control and compliance.

It acts for a large number of international and Indian clients, many of whom are household names. It works in all areas of economic activity. In addition to traditional areas of economic activity, it also majors in e-commerce and new technologies. It is also heavily engaged in work for private equity firms, reflecting the increasing importance of this sector in Indian economic growth.

Enforcement work has opened up, with more leniency applications, more rigorous investigations by the Director General and burgeoning damages actions. As well as handling investigations and hearings by the Competition Commission of India (CCI), members of the Competition Law Team also actively appeal/challenge CCI orders, whether on appeal to the National Company Law Appellate Tribunal (NCLAT) and the Supreme Court or by writ petition to the High Courts.

Merger control work also continues to grow, with the CCI carrying out increasingly detailed and demanding investigations. The practice advised on over 60 transactions in the last year. It has been involved in nearly all the Phase II investigations and is reputed for its ability to negotiate workable remedies in problematic merger cases.

Strengths

The Competition Team stands out for its extensive knowledge base, its strong analytical skills and its ability to negotiate the regulatory landscape. It has a deep and respectful understanding of the CCI and judges, whilst always fighting the client’s corner.  It has a reputation for high levels of responsiveness, for a determination to find solutions, and for “thinking outside the box”. It also seeks to maintain the highest ethical standards.

It also stands out for its bench strength. Its large partner team is supported by a growing number of associates at all levels. It operates as a single national team, enabling it to draw from a large pool to staff a matter appropriately. It can and does advise simultaneously on a number of complex and strategic cases.

The Team’s focus is on excellence and on maintaining the exacting standards set by the best international law firms and in-house counsel. It integrates effectively with in-house teams and lawyers from overseas law firms. It works with its clients to achieve the best possible solution to a case and to manage matters in line with their expectations.

The practice is at the forefront of the competition debate.  Pallavi Shroff was a member of the Competition Law Review Committee and was supported by members of the Team.
