Fernando Carreño leads the competition group at VON WOBESER & SIERRA, which includes fellow partner Fernando Moreno and 11 associates. Senior associate Paloma Alcántara rejoined the firm in July 2020 after spending a year as a visiting attorney at Cravath Swaine & Moore in New York.
Von Wobeser acted as joint counsel to Ingersoll Rand and Gardner Denver as Ingersoll spun off its industrial engineering segment and agreed to combine with Gardner. The deal was unconditionally cleared in two months by COFECE in November 2019. The team also acted for private equity firm KKR & Co, which owns Japanese automotive company Calsonic Kansei, in securing unconditional clearance for its acquisition of Fiat Chrysler’s Magneti Marelli for €5.8 billion.
The antitrust group represented Merck in an investigation by COFECE examining an alleged cartel in the market for the production, distribution and trading of pharmaceuticals in Mexico. The authority issued a statement of objections against several participants in June 2019 but found that Merck was not a party in the alleged cartel. Von Wobeser also acted for Grupo Lala in two investigations conducted by the Mexican competition authority – one for a possibly anticompetitive merger because of potentially high levels of concentration and another related to a non-notified merger in the dairy industry. Both investigations were closed without sanctions in October 2019.
