Nisha Kaur Uberoi leads the competition team at TRILEGAL, which includes one other partner, four counsel and 21 associates. The team has been active in several major deals since 2019, including acting for Schneider Electric and Temasek on their acquisition of Larsen & Toubro’s electrical and automation business. The deal was conditionally cleared by the CCI with purely behavioural remedies for the first time ever following a Phase II investigation in June 2019. Trilegal acted for Peugeot SA in its global merger with Fiat Chrysler, which the CCI unconditionally cleared in June 2020, and it represented WABCO in its sale to ZF Friedrichshafen, securing a conditional clearance after a Phase I probe in February 2020. Tata Sons, GIC and SSG turned to Trilegal to steer their acquisition of a stake in GMR Airports, while the investment arms of Intel and Qualcomm have instructed the firm to advise on their respective investments in Jio Platforms.

On the behavioural side, the team continues to act for the Port of Singapore Authority and its Indian subsidiary Bharat Mumbai Container Terminals in claims against Dubai Ports World and AP Moller Terminals for alleged collusion. Trilegal also represented NSK in its leniency application in the Electric Power Steering cartel case, securing a 100% penalty waiver for the company and its employees. Additionally, the team defended Ola against accusations of abuse of dominance, convincing the CCI to accept its arguments that Ola is not dominant in the alleged relevant markets. The NCLAT upheld the competition authority’s order in May 2020.

The team is best known for its experience in:

Defending clients before the Competition Commission of India, and the appellate forums, against cartel and abuse of dominance allegations concerning complex economic assessment and antitrust theories of harm; and  

Complex merger control cases, with a focus on strategic transactions including Phase II investigations.

The national practice head, Nisha Kaur Uberoi, currently serves as India’s non-governmental adviser for the International Competition Network and also serves in the Leadership team of the American Bar Association’s Antitrust Law Section (2019–2020). She has also been a member of the Unilateral Conduct and Behavioural Issues Working Group for the International Bar Association since 2017 and currently serves as a member of the editorial board of Global Competition Review

Nisha is internationally recognised as one of India’s leading competition lawyers, including being recognised by Chambers (Band 1), Who’s Who Legal: Competition, IFLR1000, Asialaw Leading Lawyers and Euromoney’s Women in Business Law . Nisha has also featured in Asian Legal Business’ inaugural Asia 40 under 40 and GCR 100 Women in Antitrust, as well in the A-list of India’s top 100 lawyers by India Business Law Journal and Indian Corporate Counsel Association. Prior to joining Trilegal, Nisha co-headed the competition practice at AZB & Partners and headed the competition law practice at Cyril Amarchand Mangaldas – which she set up.
