BORDEN LADNER GERVAIS has a burgeoning five-star behavioural and cartels practice group. Robert Russell leads six other partners and seven associates in offices in Toronto, Vancouver, Montreal and Calgary. The team is representing George Weston Limited and Loblaw in what a former competition commissioner described as “the largest alleged conspiracy in the history of Canadian competition law”: the bureau’s probe is evaluating the coordination of retail and wholesale prices for certain packaged bread products. The company secured immunity and the firm represents several individuals covered by that agreement. The team also handles the follow-on private litigation claims. Subrata Bhattacharjee leads the team advising Deutsche Bank in cartel litigation arising from global investigations involving foreign exchange rates and precious metals. Davit Akman is defending KEMET in multiple class actions across Canada alleging price-fixing of electrolytic and film capacitors. Russell and Denes Rothschild are counsel to British Airways in three class actions regarding air cargo, and another in which plaintiffs have alleged the airline and Virgin Atlantic fixed the price of air services between England and Quebec. On the mergers front, the firm advised the Canadian government on all competition-related aspects of its acquisition of Kinder Morgan’s Trans Mountain Pipeline project. The practice is also acting for Capital Power related to its acquisition of Goreway Power Station from Chubu Electric Power.
