After retiring from active service earlier this year, Trump turns 81 today. Judge Maryanne Trump Barry, the older sister of President Trump, hung up her gavel in February after serving more than 35 years on the bench. She had her fair share of antitrust work over that span, upholding an antitrust lawsuit against Mack Trucks in 2008, and a complaint brought by West Penn Allegheny Health System against UPMC Highmark in 2010. Perhaps her most significant contribution to antitrust case law came in 2007 when she revived Broadcom’s patent litigation against Qualcomm. There, Judge Barry found that “deception” in a standard-setting environment “harms the competitive process” by hiding the costs of using the proprietary technology and “increasing the likelihood that patent rights will confer monopoly power on the patent holder”.
