The EU General Court has annulled the European Commission’s decision to reject an abuse of dominance complaint against Poland’s largest rail freight carrier, after ruling the agency failed to adequately consider if the complainant's defence rights would be properly protected by having the Polish competition authority deal with the matter instead.
