The Federal Trade Commission will split its merger litigation resources this week, as it simultaneously challenges the Tronox/Cristal deal in its internal tribunal while seeking a preliminary injunction to block the Wilhelmsen/Drew Marine tie-up in Washington, DC, federal court. Meanwhile, the Department of Justice’s antitrust division won’t have to litigate its concerns about the Bayer/Monsanto merger, as the agrochemical companies have agreed to an estimated $9 billion worth of divestitures.
