In 2014, the Romanian Competition Act No. 21/1996 (the Competition Act) faced several amendments. The most important one was brought by the New Criminal Procedure Code and the New Criminal Code, implementing that dawn raids cannot be further initiated without a judiciary authorisation issued by the Bucharest Court of Appeal. At the same time, as per the amendments brought by the New Criminal Code, the category of individuals that may be subject to criminal liability is now limited only to individuals acting as a director or legal representative, or holding any other management position in a company that intentionally takes part in an anti-competitive practice.
