United Kingdom: Private Antitrust Litigation

In recent years we have seen potentially significant legislative developments in private antitrust litigation, both at national and EU level. We have now reached a crucial juncture at which legislative changes are due to come into force imminently with the potential to alter significantly the landscape of this historically slow-moving area of law. At a national level, the Consumer Rights Bill received royal assent on 26 March 2015, with the result that the Consumer Rights Act (the Act) is expected to come into force on 1 October 2015. Brussels has also been industrious – having made its way through the Commission over several years, the Damages Directive (the Damages Directive) was ratified by the Council on 10 November 2014 and must be implemented into the national law of member states by 27 December 2016.
