A Practical Guide to Estimating Cartel Damages: Recipe Books v Menus In our experience, a fairly standard issue in cartel damages cases is that the defendants and claimants commission reports which derive wholly different estimates of the damages. Moreover, this issue is often compounded by a lack of clarity on why these differences arise, such as the extent to which they are a result of differences in the assumptions, data and estimation techniques used.
