France: Merger Control

The French merger control regime is governed by the provisions of Book IV of the French Commercial Code and more particularly by Title 3 (article L430-1 et seq), as amended by the Law on the Modernisation of the Economy (LME), Law No. 2008-776, enacted on 4 August 2008 and the Government’s Order No. 2008-1161 dated 14 November 2008, which has been implemented pursuant to the LME. Moreover, on 16 December 2009, the Competition Authority also issued new guidelines on merger control.
