Spain: Telecoms and Media

Regulatory speaking, 2009 has been a very prolific year in the Spanish telecommunications sector, just as the previous one was. The Telecommunications Market Commission (TMC) has completed most of its second market review, which began in 2008, and in addition, some relevant developments have taken place within the Spanish telecommunications regulatory framework. Some of the most relevant developments are the final Next Generation Networks regulation, which was published in January this year, and the designation of the operators that are required to contribute to the Universal Service National Fund (in spite of all the arguments raised by the relevant operators opposing their designation). Furthermore, the Ministry of Industry, Commerce and Tourism (the Ministry) has introduced the Consumer's Rights Charter, and has further regulated the short and multimedia messaging services (SMS and MMS, respectively).
