Key points Australia’s merger control regime is contained in the Competition and Consumer Act 2010 (Cth) (CCA), and is vigorously administered by the Australian Competition and Consumer Commission (ACCC), which administers the merger control regime pursuant to its Merger Guidelines and its Informal Merger Review Process Guidelines. The Process Guidelines were updated in September 2013 to reflect recent developments in the ACCC’s approach to informal clearances and to improve the efficiency and transparency of the ACCC’s informal review process.
