MRW sees off disclosure threat

A decision under Regulation No. 17 has been partly annulled. On February 20, 2001, the European Court of First Instance annulled the main parts of a decision of the European Commission under Article 11 §5 of Regulation No. 17. The judgment states that Mannesmann Röhrenwerke (MRW), which was subject to a Commission cartel investigation, is not obliged to respond to requests for information that would force it to admit to an alleged participation in a cartel. In particular, MRW was not obliged to disclose information regarding the agendas and results of meetings which were not documented.
