The Federal Trade Commission’s suit to unwind Altria’s 35% investment in Juul kicked off yesterday in the commission’s administrative court, with Judge D Michael Chappell presiding. The agency’s chief administrative law judge asked earlier this week if there was such a thing as a straightforward case. If it is, “it’s settled already”, he said. But David Gelfand, counsel to Juul at Cleary Gottlieb Steen & Hamilton, claims this case is straightforward, arguing that it should have been “dead on arrival”.
