Textualists unite: The Tipline for 19 January 2022

Antitrust progressives argue that much of what Congress intended in crafting the US antitrust laws has been hijacked by activist academics, economists and judges. Lina Khan and Jonathan Kanter cannot write legal precedent outlining that vision, but they can try and persuade the courts with new guidelines. Also in textualism news, Google, Apple and Amazon warn that the language in Congress’ self-preferencing bill risks grave dangers to the quality of their products.
