Tying claim against CVS could affect Aetna deal, observers say

As the Department of Justice reviews CVS Health’s $69 billion purchase of Aetna, a healthcare information technology company has sued the pharmacy chain and benefit manager for allegedly forcing the plaintiff’s customers to use its subsidiary Wellpartner’s services in violation of federal antitrust laws.

The Federal Trade Commission and House Judiciary Committee appear to be stuck in a stalemate regardless of whether their quarrel occurs in letters or public hearings. Pressed by Republican lawmakers about the FTC’s responses (or lack thereof) to various document demands, the commission’s director of congressional relations had very little to say. “I’m not able to provide that information today, but we're happy to continue talking to your staff,” Jeanne Bumpus said.
