The lawyers defending five of the broiler chicken executives facing a third price-fixing trial say they deserve additional time to question and challenge the selection of jurors because of assistant attorney general Jonathan Kanter’s conduct this month. One of the acts in question is Kanter encouraging Department of Justice staff to listen to Tom Petty’s “I Won’t Back Down” after the second mistrial. Defence counsel said telling staff to “dance like no one is watching” to the song “shows a startling disrespect for our criminal justice system”.
