Third Circuit revives egg product purchasers’ claim

Finding that neither its own prior cases nor the Supreme Court’s Illinois Brick prohibit the price-fixing claims brought by egg product purchasers against egg suppliers, the US Court of Appeals for the Third Circuit has overturned a lower court’s judgment that deemed egg product purchasers lack antitrust standing.
