The lawsuits against property management software company RealPage are stacking up but the Department of Justice has remained sidelined. That was until yesterday when the Antitrust Division endorsed private plaintiffs’ view that the conspiracy would constitute a per se violation of the Sherman Act. Having dismissed two criminal cases this week, the agency may have some free prosecutors.
