Supreme Court Justice Hugo Black was born 134 years ago today in Alabama, but he would not be buried there. His vote to deem racial segregation in US public schools unconstitutional in Brown v Board of Education would result in the Alabama state senate voting to prohibit his burial within state lines. He is one of 13 justices to be buried at Arlington National Cemetery. In 1945, he wrote for the majority in Associated Press v United States, finding that the press was not immune from antitrust law and that the AP’s membership veto powers were anticompetitive because they prohibited potential competitors.
