The second phase of Anthem/Cigna begins today, which will focus on how the mega-merger will affect competition for health insurance in local markets. Even though Judge Amy Berman Jackson, who is presiding over the case in Washington, DC federal court, could still make a decision on the first phase within the next few days, we shouldn’t be quick to assume what she’ll decide. “We’re going on to Phase II,” she said yesterday in court. “No one should draw any conclusions from that one way or another.” A ruling in favour of the Department of Justice would block the Anthem/Cigna tie-up and make the second part of the trial redundant.
