Who could forget when Uncle Ben warned Peter Parker about the dangers of collusion? “With great Powers comes great responsibility,” Spiderman’s uncle said, in a clear reference to the potential for criminal liability should he consider violating Section 1 of the Sherman Act during the tenure of deputy assistant attorney general Richard Powers. The Department of Justice’s top antitrust prosecutor has now departed for private practice, perhaps freeing up an opportunity for Spiderman to allocate markets for vigilante justice with other Avengers. Also in Tipline, the DOJ asks an appellate court for a sweeter merger opinion and more golfers drop out of the high-profile lawsuit against the PGA Tour.
