Ninth Circuit revives wholesalers’ Robinson-Patman claims

A group of wholesalers can pursue allegations that an energy drink manufacturer violated the Robinson-Patman Act by providing Costco with unfair discounts, a divided panel on the US Court of Appeals for the Ninth Circuit has ruled.
