Assistant attorney general Jonathan Kanter is about done defending the age of some of the case law cited in the US agencies’ draft merger guidelines. On Thursday, he asked a Brookings Institution audience if they had heard of Brown v Board of Education. “My recollection from law school is that Supreme Court cases don’t expire,” Kanter said of the court’s 1954 decision striking down public school segregation.
