Up in smoke: The Tipline for 3 October 2022

For the better part of two years, the Federal Trade Commission litigated against an agreement between Altria and Juul not to compete against each other in the market for vape cigarettes. The commission lost before its administrative tribunal, but perhaps can count a win in the end. In shades of AT&T selling off its Time Warner assets, the Marlboro maker is ditching the terms of its noncompete with Juul as the latter struggles to get regulatory approval from the Food and Drug Administration to market its products. Also in Tipline, the Department of Justice fails once again to enjoin US Sugar/Imperial Sugar and Amazon escapes claims that it conspired with publishers over book sales.
