The Sherman Act celebrates its 131st birthday today and you would not be able to tell by looking at it. After years of hobbling around, Section 2 is back up and running like it’s in its 20s again. But celebrations for Senator John Sherman’s crowning legislative achievement have been upstaged. Democratic members of the Federal Trade Commission voted on Thursday to “recommit” to the original mandate of the Sherman Act’s younger sibling, Section 5 of the FTC Act.
