Ten years ago today, the Supreme Court divided along predictable ideological lines – Justice Anthony Kennedy given the majority opinion, and joined by Chief Justice John Roberts and Justices Antonin Scalia, Clarence Thomas and Samuel Alito – to declare that resale price maintenance is not per se illegal. “We now hold that Dr Miles should be overruled and that vertical price restraints are to be judged by the rule of reason,” Justice Kennedy wrote.
