One year ago today, Judge Lucy Koh ruled in favour of the Federal Trade Commission in finding that Qualcomm monopolised the market for certain modem chips. FTC counsel may have celebrated with high-fives and a round of drinks while enjoying each other’s company. Today, they are doing none of that as they work from home, worrying that the Ninth Circuit will soon take away their section 2 triumph.
