FTC tech enforcer: agencies can’t block deals based on unknown products
The horizontal merger guidelines “very clearly recognise” that the acquisition of a nascent competitor could be illegal, but existing case law does not permit mergers to be rejected based on harm to future products, the assistant director of the Federal Trade Commission’s technology enforcement division has said.
