Even non-frivolous petitions can be a basis for finding antitrust liability, a Federal Trade Commission lawyer said on Monday – but a former advisor for acting FTC chairman Maureen Ohlhausen said that wasn’t a viable theory.

The Federal Trade Commission and House Judiciary Committee appear to be stuck in a stalemate regardless of whether their quarrel occurs in letters or public hearings. Pressed by Republican lawmakers about the FTC’s responses (or lack thereof) to various document demands, the commission’s director of congressional relations had very little to say. “I’m not able to provide that information today, but we're happy to continue talking to your staff,” Jeanne Bumpus said.
