FTC judge won’t see two 1-800 Contacts defences

The three remaining members of the Federal Trade Commission granted partial summary judgment against 1-800 Contacts last week, holding that the contact lens retailer cannot raise affirmative defences that its allegedly anti-competitive conduct in online advertising is immunised by the First Amendment or the reasonableness of its intellectual property disputes.
