Labor Day has taken on new meaning at the US antitrust agencies. After years of criticism that the American worker was an afterthought for competition enforcers, the Department of Justice has brought numerous labour cases to court – albeit without many victories. But the business community is now paying attention. Former Burger King employees are preparing to take up the baton once again after a federal appellate court revived their no-poach class action against the fast food chain, while tax preparer employees are seeking certification in their own no-poach claims against the country’s second-largest such service.
