The Department of Justice may use binding arbitration to resolve product market definition in its lawsuit to block the purchase of aluminium sheet maker Aleris by rival Novelis.

Following a jury trial win just before Thanksgiving, which found that egg producers and trade groups conspired to restrict output, the former head of the Federal Trade Commission’s bureau of economics is now arguing for treble damages in that lawsuit.
