Coordinated effects confuse some judges, says Hoffman

Translating an enforcement agency’s theory that a merger will enable remaining market operators to coordinate into an argument that judges will accept poses some “inherent difficulties”, the head of the Federal Trade Commission’s bureau of competition has said.
