During Charles River Associates’ annual conference in Brussels on Thursday, White House special assistant Tim Wu heralded the US for appointing “a new generation of tough enforcers, the trustbusters of our era”. Wu praised the Federal Trade Commission and Department of Justice for going on “a bit of a winning streak” – and not because they are “chickenshit lawyers” who only take winnable cases. The executives facing price-fixing charges in Denver know a thing or two about chickens and are well aware the DOJ is not afraid to lose in court, though five of them have successfully avoided a third trial.
