Trilegal

14 January 2020

India

The large competition team at TRILEGAL is made up of practice head Nisha Kaur Uberoi, fellow partner Soumya Hariharan, five counsel and 27 associates. It advised Schneider and Temasek on the acquisition of the electrical and automation business of Larsen & Toubro. Following a Phase II investigation, the Competition Commission approved the deal with no divestitures and minimal behavioural remedies. The firm acted for Singapore wealth fund Tata Sons and SSG Capital Management on the competition law aspects of their $1.15 billion investment in GMR Airports.

Trilegal successfully defended Ola against accusations of abuse of dominance, in the first Indian case alleging predatory pricing on multi-sided platforms. The authority accepted the firm’s argument that the ride-hailing company faced sufficient competitive constraints so as not to be considered dominant in all of the relevant markets. The case is now before the appellate tribunal. The firm successfully represented International Spirits and Wines Association of India in a complaint against the Uttarakhand Agricultural and Marketing Board – a governmental body – and two affiliates regarding an abuse of dominance in the procurement and distribution of alcohol by state-owned companies.
