BORDEN LADNER GERVAIS has a burgeoning five-star behavioural and cartels practice group. Robert S Russell leads 12 partners and seven associates in offices in Toronto, Vancouver, Montreal and Calgary. The team represented Loblaw and its subsidiary Shoppers Drug Mart in the bureau’s abuse of dominance investigation into the grocery retailer, with partners Russell and Davit Akman helping it to win a complete victory in 2017. They’re now assisting Loblaw as the immunity applicant in a criminal investigation into bread cartels, and fended off a court challenge that claimed the waivers it required affected consumers to sign to receive compensatory gift cards were misleading. In December 2017, Loblaw acknowledged its “role in an industry-wide price-fixing arrangement involving certain packaged bread products” from late 2001 to March 2015; claimants have launched several class actions against the company. Partner Subrata Bhattacharjee leads the team advising Deutsche Bank in cartel litigation arising from global investigations involving foreign exchange rates and precious metals. Akman defends KEMET in multiple class actions across Canada alleging price-fixing of electrolytic and film capacitors. Russell and partner Denes Rothschild are counsel to British Airways in three class actions regarding air cargo, and another in which plaintiffs have alleged the airline and Virgin Atlantic fixed the price of air services between England and Quebec. On the mergers front, the firm advised the Canadian government on all competition-related aspects of its acquisition of Kinder Morgan’s Trans Mountain pipeline project. Borden Ladner also acts for COSCO Shipping on its acquisition of Orient Overseas International; for licensed cannabis producer CanniMed after being acquired by Aurora Cannabis; and for natural resources company Bedrock Industries in its acquisition of US Steel Canada.
