The Dechert team that made its mark on Wholefoods/Wild Oats and Express Scripts/Medco continues to develop its reputation as one of the foremost firms in the district for merger work. The antitrust practice is involved in two of the most contentious deals this year, working for US Airways on its tie-up with American Airlines and for OfficeMax in its three-to-two merger with Office Depot. The firm helped see both deals through to closing – a truly outstanding result for the firm. The team also helped Buckeye Technology through its sale to Georgia Pacific, which survived a second request from the DoJ. It was quite the year forWho’s Who Legal nominee Paul T Denis and the Dechert team.

In litigation matters, Dechert represented Actelion Pharmaceuticals in a pharma case that gave rise to one of the hottest topics in antitrust last year – whether a branded drug maker is obligated to sell samples of a patented drug to potential generic rivals. The FTC filed an amicus brief in that case.

The team also advised Travelport in a bet-the-company lawsuit against American Airlines, whose claims were partially thrown out in 2011 before the case settled in March this year. Dechert is also advising Microsoft in monopolisation allegations surrounding its subsidiary Skype, and it continues to advise Dean Foods in an appeal of a judgment in favour of the company stemming from the southeastern milk antitrust litigation.
