The return in 2012 of Who’s Who Legal nominee Paul Collins after a stint at the Competition Bureau gave the team at Stikeman Elliott a real boost. Competitors say its bench remains among the most talented and well-regarded in the country, with fellow Who’s Who Legal nominees Susan H Hutton, Shawn C D Neylan and Katherine L Kay handling a full array of competition work, from mergers to bureau investigations and follow-on class actions, and up-and-coming talent in the form of senior associate Michael Kilby. Counsel and Who’s Who Legal nominee Lawson A W Hunter, head of the competition practice during Collins’s absence, also maintains a full-time practice with the group and continues to be involved in many high-profile transactions.

The firm’s merger shop has had another successful year, with Collins and Kilby advising supermarket Sobeys on its successful C$5.8 billion takeover of Safeway’s Canadian business. The deal came under significant scrutiny, creating the country’s second-largest supermarket and the market leader in some regions. Collins is also advising US forestry giant Louisiana-Pacific on Canadian aspects of its acquisition of Vancouver-based Ainsworth Lumber for US$1.1 billion. Hunter and Hutton continue to advise China National Offshore Oil Company in its contentious US$15 billion merger with Nexen, which is still under review at the Competition Bureau.

The contentious side of the practice has been booming over the past few years, led by Kay, one of Canada’s headline competition litigators. The team has been advising defendant Canadian Imperial Bank of Commerce in perhaps the largest set of class actions ever filed in Canada, seeking damages for alleged conspiracy on credit card interchange fees. Her team is also representing HarperCollins in the e-books litigation, Air Canada in the follow-on air cargo cartel class actions, multiple car parts manufacturers and Infineon Technologies in DRAM class actions in Quebec, British Columbia and Ontario.
