United States: California

Morrison & Foerster LLP's antitrust practice continues to thrive. Former FTC deputy assistant director Sean Gates joined the San Francisco antitrust team in 2008, and has since worked on some of the firm's most complex and high-profile antitrust cases.

The MoFo team has over the past year been advising Seiko Epson Corporation and its subsidiaries in its defence against allegations it participated in the LCD cartel. The team has also helped lead AirTran Airways in its defence of a class action accusing it of conspiring to fix the price of baggage fees, and Clorox in a Robinson-Patman Act case alleging price discrimination in the sale of auto care products.

Merger work has included advising Astellas Pharma in its offer for OSI Pharmaceuticals, the second-largest US pharma acquisition by a Japanese buyers, and Cogent in its buyout by 3M, among others.

United States: Government Antitrust

Morrison & Foerster LLP's antitrust group includes six partners, two of counsel and 12 associates. Partners Steve Smith and David Meyer co-chair the competition group.

The team divides its time fairly evenly between merger work, civil investigations and cartel work, both before the US antitrust authorities and in private claims.

Seiko Epson Corporation relies on the firm for antitrust advice, including in the high profile TFT-LCD case, where defendants are accused of conspiring to fix, raise or maintain the price of LCD panels.

The firm represents AirTran Airways in a class action lawsuit alleging that AirTran and Delta conspired to set airline baggage fees, and it is counsel to Clorox on antitrust matters, including litigation, M&A and general counselling.

On the transactional front, Morrison & Foerster successfully represented Astellas Pharma before the Federal Trade Commission in its $4 billion tender offer for OSI Pharmaceuticals. It is also serving as antitrust counsel to Via Licensing in its efforts to form a patent pool for 4G wireless technology.

Other clients include FDK Corporation, Fujitsu Limited, JPMorgan Chase and United Parcel Services.
