Horizontal history: The Tipline for 19 August 2019
There are some moments in history that stick out in our minds. You undoubtedly remember where you were nine years ago today when the Federal Trade Commission and the Department of Justice jointly issued a revised version of the Horizontal Merger Guidelines. The competition enforcers made the first significant revisions to the holy documents of US merger control in 18 years. Among other changes, the agencies updated the concentration thresholds determining whether a deal warrants further scrutiny and clarified that the enforcers do not use a single methodology in their analysis.
