The Supreme Court of India recently held that, prima facie, Uber seems to have engaged in predatory pricing and called for an investigation into the matter. Ganesh Khemka, a judicial clerk in the Supreme Court of India, and Madhavi Singh, a master’s candidate at the University of Oxford, argue that the court equated below-cost pricing with predatory pricing resulting in the creation of a dangerous precedent that could spell the end of deep discounting strategies by new entrants.
